Please read these Terms and Conditions carefully before booking any trek, tour, or adventure activity with High Mountain Wave Trekking. By booking with us, you agree to be bound by these terms and conditions.
1. Booking and Confirmation
- Booking Form: To book a trip with High Mountain Wave Trekking, you must complete our online booking form or submit a written request.
- Deposit: A non-refundable deposit of 20% of the total trip cost is required at the time of booking to confirm your reservation.
- Final Payment: The remaining 80% of the total trip cost is due upon your arrival in Kathmandu, before the commencement of your trek or activity. We accept cash (USD, EUR, GBP, AUD, CAD), bank transfer, or credit card payments (Visa, MasterCard – a 3.5% bank charge applies for credit card payments).
- Confirmation: Your booking is confirmed only after High Mountain Wave Trekking receives your deposit and you receive a confirmation email from us.
2. Cancellation Policy
Cancellation by the Client:
- More than 30 days prior to departure: The 20% deposit is non-refundable.
- 15-30 days prior to departure: 50% of the total trip cost will be charged as a cancellation fee.
- Less than 15 days prior to departure or "No Show": 100% of the total trip cost will be charged as a cancellation fee.
- Partial Cancellation: No refunds will be provided for any unused services, accommodations, or activities once the trip has commenced.
Cancellation by High Mountain Wave Trekking:
High Mountain Wave Trekking reserves the right to cancel any trip due to unforeseen circumstances beyond our control, including but not limited to: natural disasters, political instability, strikes, acts of terrorism, or other force majeure events.
- In such cases, we will offer you an alternative trip of similar value or a credit for a future trip.
- If no suitable alternative is available or acceptable, we will refund the amount paid, minus any non-recoverable costs incurred by us (e.g., permits, non-refundable flight tickets). We will not be responsible for any incidental expenses you may have incurred as a result of your booking, such as visas, vaccinations, or non-refundable flights.
3. Changes to Bookings
Changes by the Client:
- Minor Changes: We will do our best to accommodate minor changes to your itinerary after booking, but this is subject to availability and may incur additional charges.
- Major Changes: Major changes, such as a change in departure date or destination, may be treated as a cancellation and re-booking, subject to our cancellation policy.
Changes by High Mountain Wave Trekking:
While we endeavor to operate all trips as advertised, we reserve the right to modify or reschedule itineraries due to unforeseen circumstances or safety concerns.
- Any changes will be communicated to you as soon as possible.
- If a significant change (e.g., a change in destination or a major reduction in trip duration) occurs, you will be offered an alternative of comparable value or a partial refund for the services not provided.
4. Travel Insurance
It is mandatory for all clients to have comprehensive travel insurance that covers personal accident, medical expenses, emergency evacuation, repatriation, trip cancellation, loss of luggage, and personal liability. You must provide proof of valid travel insurance prior to the commencement of your trip. High Mountain Wave Trekking will not be held responsible for any costs incurred due to lack of adequate insurance coverage.
5. Health and Fitness
- You must be in good physical and mental health to participate in our treks and activities.
- It is your responsibility to consult with your doctor regarding your fitness to travel and any necessary vaccinations.
- You must inform High Mountain Wave Trekking of any existing medical conditions, allergies, or disabilities at the time of booking. We reserve the right to decline a booking if we believe an individual's health condition poses a risk to themselves or others.
6. Authority on Tour
- Our trip leader or guide has the ultimate authority on the trip. By booking with us, you agree to abide by their decisions, particularly in matters of safety and group well-being.
- Failure to comply with the guide's instructions, or engaging in behavior that endangers yourself or others, may result in your removal from the trip without refund.
7. Responsibilities of High Mountain Wave Trekking
High Mountain Wave Trekking is responsible for:
- Providing services as described in the agreed-upon itinerary.
- Ensuring the safety and well-being of our clients during the trip to the best of our abilities.
- Employing experienced and qualified guides and staff.
- Using reliable transportation and quality accommodations.
8. Limitation of Liability
High Mountain Wave Trekking acts only as an agent for the various independent suppliers that provide transportation, accommodation, and other services connected with your tour. We are not liable for any loss, injury, damage, or expense, including those that result from:
- Acts or omissions of independent suppliers.
- Force majeure events (as described in Section 2).
- Your own negligence or participation in dangerous activities.
- Loss or damage to personal belongings.
9. Assumption of Risk
You acknowledge that trekking, touring, and adventure activities in the Himalayas involve inherent risks, including but not limited to: altitude sickness, unpredictable weather, challenging terrain, injuries, and remote medical facilities. By booking with High Mountain Wave Trekking, you voluntarily assume these risks.
10. Complaints
If you have a complaint during your trip, please inform your guide or trip leader immediately so that they can attempt to resolve the issue. If the matter cannot be resolved locally, please notify High Mountain Wave Trekking in writing within 30 days of the completion of your trip. We will investigate the matter and respond promptly.
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
12. Updates to Terms and Conditions
High Mountain Wave Trekking reserves the right to update or modify these Terms and Conditions at any time. The most current version will always be posted on our website. Your continued use of our services after any changes indicates your acceptance of the revised terms.
